The Tamale High Court has granted an order of interlocutory injunction stopping Yussif Toyibu (Agenda) from holding himself as Regional Treasurer for the New Patriotic Party in the Northern region pending the final determination of the suit against him.
“Upon hearing Sheikh Arif Abdullah, Esq. counsel for and behalf of the plaintiff/applicant herein; it is hereby ordered that the 2nd defendant herein, whether by himself, his agents, workmen, assigns and all privies are restrained from holding himself as Regional Treasurer for New Patriotic Party in the Northern region pending the final determination of the suit.”
Justice of the High Court, Daniel K. Obeng who presided over the case reportedly issued an order following an ex parte application for an order of interlocutory injunction filed by Abdulai Iddrissu Dipantiche as plaintiff.
The suit has Mohammed A. Baantima Samba, Yussif Toyibo, Yussif Danjummah and the New Patriotic Party (Northern Region) as the 1st, 2nd, 3rd and 4th defendants respectively sued in the suit marked NR/TL/HC/E13/1/2022.
The order according to the court shall subsist for a period of 10 days where the plaintiff shall serve a copy of the order and writ of summons on all the defendants for the suit to take its normal course.
It will be recalled that the plaintiff who doubles as the Executive Director of Dombo Foundation Ghana, Abdulai Iddrissu Dipantiche sued the Regional Chairman Samba, two others and the NPP, Northern region for allegedly appointing the 2nd and 3rd defendants without recourse to the party’s constitution.
The plaintiff’s claim against the defendants is for a declaration that the appointment of the 2nd and 3rd defendants as NPP Northern Regional Treasurer and Assistant Secretary respectively contravenes the NPP constitution.
The Plaintiff says the defendants have deliberately ignored the express provisions of the NPP constitution to impose their preferred candidates on the rest of the party.
He further prayed the court for an order of perpetual injunction restraining the 2nd and 3rd defendants from acting as NPP Northern Regional Treasurer and Assistant Secretary respectively.
However, the application to place an injunction on the 3rd defendant was refused by the Tamale High Court.
